TARDUS TEMPUS – Holiday Apartment

1. General

These general terms and conditions apply to all reservations and stays in the Tardus Tempus holiday apartment. By making a reservation, the tenant confirms having read and accepted these terms and conditions.

By confirming a reservation and/or completing the payment, the tenant declares having read and accepted these General Terms and Conditions in full and without reservation. These terms form an integral part of the rental agreement.

2. Reservation and payment

After making a reservation, the tenant will receive a confirmation by email.
The reservation becomes final upon receipt of the agreed deposit.
The deposit amounts to 25% of the total rental price.
The remaining balance must be paid no later than four (4) weeks prior to arrival.
For reservations made within four (4) weeks prior to arrival, the full rental amount must be paid immediately.

3. Rental price and included services

The rental price includes the use of the entire apartment, bed linen and towels, utilities, WiFi, use of the communal swimming pool, and an underground parking space.
Not included are damages, losses, or additional cleaning costs.
Charging station available at an additional cost.
Final cleaning is a mandatory additional charge.

4. Cancellation by the tenant

Cancellations must always be submitted in writing by email.

·       Up to 30 days before arrival: 25% of the rental amount will be charged

·       Up to 15 days before arrival: 50% of the rental amount will be charged

·       From 15 days before arrival or in case of no-show: 100% of the rental amount will be charged

5. Cancellation by the landlord

If the landlord is forced to cancel the stay due to force majeure or unforeseen circumstances, all amounts paid will be refunded within 48 hours.
The tenant is not entitled to any additional compensation.

6. Arrival and departure

Check-in is possible from 2:00 PM until 12:00 AM on the day of arrival.
Check-out must take place no later than 10:00 AM on the day of departure, unless otherwise agreed.
Arrivals or departures between 10:00 PM and 6:00 AM are subject to a surcharge of €30, payable in advance.

7. House rules

Smoking and pets are not allowed.
The maximum occupancy of four (4) persons may not be exceeded.
Parties and noise disturbance are prohibited.
Children must always be supervised, especially near the swimming pool.
The apartment may only be used for holiday purposes.
In case of serious or repeated violation of the house rules, the landlord reserves the right to terminate the stay immediately without refund.

8. Guest identification (Spanish legislation)

In accordance with Spanish law, the tenant is required, together with all accompanying guests, to provide the legally required identification details.
These details may be requested by Tardus Tempus prior to arrival, in particular for the purpose of mandatory guest registration.
The tenant and all guests must, where applicable, be able to present a valid official identity document (passport or national identity card) upon arrival in order to verify the provided information.
Personal data are processed exclusively for the purpose of legal registration obligations and in accordance with applicable data protection regulations.

9. Liability and condition of the property

The tenant is fully liable for any damage to the apartment, furniture, equipment and common areas caused during the stay by the tenant, accompanying guests or visitors.

Upon arrival, the apartment is deemed to have been received in good condition and in accordance with the description, unless the tenant reports any defects in writing within 12 hours after arrival.

Any damage or excessive cleaning identified during or after the stay will be communicated to the tenant in writing, including a specification of the defects and the corresponding repair, replacement or additional cleaning costs.

The tenant undertakes to settle these costs within seven (7) calendar days after receipt of the written notification.

The landlord reserves the right to provide supporting evidence (such as photographs, quotations or invoices).

The landlord shall not be liable for theft, loss, accidents, temporary interruption of utilities or nuisance caused by third parties.

If the tenant fails to voluntarily pay the claimed compensation within the stipulated period, the landlord reserves the right to initiate legal proceedings, with all additional costs to be borne by the tenant.

10. Complaints

Any complaints must be reported immediately during the stay via info@tardus-tempus.com so that an appropriate solution can be sought.

11. Website and information

All information on the website is provided in good faith. Obvious errors or mistakes are not binding.
The landlord reserves the right to modify the content and these terms and conditions.
Photos are indicative and may show minor deviations.

12. Privacy

Personal data are processed exclusively for reservations, communication, and legal obligations, in accordance with applicable privacy legislation.

13. Applicable law

This agreement and all obligations arising from or related to it are governed exclusively by Spanish law.
Any disputes arising from or related to this agreement fall under the exclusive jurisdiction of the competent courts of the place where the accommodation is located.
This clause does not affect mandatory consumer protection provisions.
